Agreement to Terms

By accessing and using Qualisync Build services ("Services"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the terms of this agreement, you are not authorized to use or access our services.

Service Description

Qualisync Build provides development services including but not limited to:

• Web development (landing pages, websites, web applications)
• Mobile application development (iOS and Android)
• Desktop application development (Windows, macOS, Linux)
• AI integration and machine learning services
• Ongoing management and maintenance services

Development Process

Fixed-Price Projects

• Projects are scoped and quoted at a fixed price after consultation
• Unlimited revisions are included within the original project scope
• Changes beyond the original scope will require a new project agreement
• Payment schedule: 50% deposit to start, 50% on completion (or milestone-based for larger projects)

Revision Policy

"Unlimited revisions" includes:

• Design tweaks and visual adjustments
• Content updates and copy changes
• Bug fixes and performance optimization
• Security updates within original framework

Revisions are limited to one revision request per week, which may include multiple changes but must be submitted as a single comprehensive request.

Management Services

Pricing Models

• MAU-Based: Monthly fees based on Monthly Active Users ($199-$1,299/month)
• Revenue-Based: Fees calculated as a percentage of your application's revenue
• End-to-End (E2E): Premium management at 1.5-2x standard rates with full administrative control

Service Levels

Management services include monitoring, updates, basic support, and performance optimization. Response times vary by plan tier.

Intellectual Property

Upon full payment of development fees:

• You receive full ownership of all custom code, designs, and assets created for your project
• Complete source code access and documentation are provided
• You maintain full administrative control of your project
• Qualisync retains rights to reusable components and methodologies

Client Responsibilities

• Provide necessary project materials, content, and access
• Respond to revision requests and feedback in a timely manner
• Make payments according to the agreed schedule
• Maintain confidentiality of any proprietary information shared

Warranties and Disclaimers

We provide:

• 30-day bug fix warranty on all development work
• Professional-grade code following industry best practices
• Security measures appropriate to project requirements

Services are provided "as is" without warranty of any kind beyond our explicit guarantees. We disclaim all implied warranties including merchantability and fitness for a particular purpose.

Limitation of Liability

In no event shall Qualisync Build be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the services.

Termination

Either party may terminate ongoing management services with 30 days written notice. Development projects may be terminated only by mutual agreement, with payment due for work completed.

Governing Law

These terms shall be interpreted and governed by the laws of the jurisdiction where Qualisync Build operates, without regard to conflict of law provisions.

Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Continued use of our services after changes constitutes acceptance of the new terms.
